Wrongful Death Lawsuits
An action for wrongful death must be brought by the estate administrator ("executor") of the person's estate. (Individual family members cannot file their own lawsuits.) The surviving spouse, children, or parents can be compensated for the following:
- Funeral expenses and medical bills not covered by other insurance
- Future earnings the deceased would have earned
- Pain and suffering of the victim prior to death
- Emotional damages for loss of companionship
In Indiana, some wrongful death claims are capped at $300,000, though there are exceptions. Kentucky law does not set a maximum recovery for wrongful death. In both states, a wrongful death claim must be filed within one year of the date of death (not the date of the accident), though the period can sometimes be extended.
