Motorcycle Accident Liability
The leading cause of motorcycle collisions is negligence of the other driver. This is due to the fact that because of the small size of the motorcycle as compared to an automobile, it’s more difficult to see. As a result, the most common motorcycle accident is an automobile driver making a left hand turn at an intersection and failing to yield to an oncoming motorcyclist who has the right-of-way. It is not uncommon for the at-fault automobile driver to claim that they didn’t see the oncoming motorcyclist until it was too late. Alcohol use and excessive speed are also common factors contributing to many motorcycle accidents.

Investigating the Motorcycle Accident
One of the first steps I take in a motor accident case is to personally conduct a thorough investigation. I will determine what factors played a role and search for evidence that shows the other driver caused the accident by:

• Inattentive or reckless driving, such as talking or texting o a cell phone, eating, or focusing on an ipod or radio.

• Driving while under the influence of alcohol, drugs or prescription medicine that prohibits driving.

• Committing a moving violation such as speeding, running a red light or stop sign, or failing to yield.

• Following too closely, not signaling a lane change, failing to maintain a lane, or driving aggressively.

• Not having a required valid Kentucky or Indiana driver’s license.
